		<description><![CDATA[I have a 2008 335xi that I picked up in September &#039;07.  I have had all the same issues as I am reading about here - at least 4 times to the dealer for new fuel injectors and new fuel pumps.  Also have had issues with the rear brake lamps/mechanisms needing replacement.  As much as I love the power of the 335 I am on the verge of trading this in for a 328xi so I don&#039;t have to deal with the service issues of this turbo.  This is my 4th 3 series and no other car I&#039;ve owned drives like it.  But the experience with this engine malfunction is ridiculous.]]></description>

		<description><![CDATA[MJ - You are not up a creek without a paddle. There are other federal protections, such as the Magnuson-Moss Warranty Act (also known as the Federal Lemon Law) that will protect you. The verbiage contained in the Act is something in the lines of: “if the product, or a component part, contains a defect or malfunction, must permit the consumer to elect either a refund or replacement without charge, after a reasonable number of repair attempts.”. Additionally, the federal law allows for depreciation of the vehicle in the refund, so, if you have 40,000 miles on the vehicle, it will prorate the mileage at $X per mile (don’t know it off the top of my head) and refund the price of the vehicle less the depreciation. 

Now MJ – Looking at the Colorado Lemon Statutes C.R.S. 42-12-101, it states “If you buy a new vehicle that has a defect within one year following the purchase, and the same defect is not repaired after four or more attempts to repair,” This means that FIRST time the defect on the vehicle occurs within the FIRST year of operation; which is defined by the same symptom, irrespective of what was fixed… then you are protected for the duration of owning the vehicle. In other words, you’re indefinitely protected if your first issue occurred within the first year of ownership of the vehicle. I hope this helps! Good luck!]]></description>

Just took my baby to the dealership for the third time..after injectors, spark plugs, fuels pumps and nmore have been replaced. Frustrated yes, but yesterday - that great car (with no warning) almost died while I was accelerated. This not only was frustrating, it was scary as I had no power to stay in flow with traffic...in essence this safety issue is now my concern. Our lemon law (Colorado) is first 12 months or 12K miles. So, in your research does this mean I am hosed? Or do you recommend that I still contact BMW for some type of reckoning? thx, MJ]]></description>

I have had 2 fuel pumps, 1 fuel injector and 2 software replacements in 15,000 miles. Very frustrating since I drive in remote areas. Usually preceded by poor starts.
